Terms of Service

By using Vailea's website, email tools, or mobile app (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Vailea provides general plant-care guidance, reminders, and AI-assisted photo analysis. The Service is currently free. Paid features may be introduced later with separate notice.

2. Not professional advice

Content in Vailea is for informational purposes only. It is not professional horticultural, veterinary, medical, or emergency advice. For toxic ingestions (pets or people), contact a qualified professional immediately. You are responsible for decisions about your plants and home.

3. AI and accuracy

Diagnosis results are estimates based on photos and context you provide. Results may be incomplete or incorrect. Always verify care steps against your plant’s specific needs and conditions.

4. Eligibility

You must be at least 13 years old (or the minimum age in your country) to use the Service. By using Vailea, you confirm you meet this requirement.

5. Your content

You retain ownership of photos and information you submit. You grant us a limited license to process that content solely to operate and improve the Service (e.g. run diagnosis, store saved plant profiles on your device or account).

6. Acceptable use

You agree not to:

  • Use the Service for unlawful purposes.
  • Attempt to disrupt, scrape, or reverse-engineer our systems.
  • Submit harmful code or misleading information.
  • Impersonate others or abuse support channels.

7. Email communications

If you submit your email, you may receive results and optional tips. You can unsubscribe at any time via the link in our emails. See our Privacy Policy for data practices.

8. Third-party links

The Service may link to app stores or third-party sites. We are not responsible for their content or practices.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Vailea AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PLANTS, DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF (A) USD $50 OR (B) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM (CURRENTLY $0 FOR FREE USERS).

11. Changes

We may modify these Terms or the Service at any time. Continued use after changes constitutes acceptance. We will update the “Last updated” date above.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if required for legal or security reasons.

13. Governing law

These Terms are governed by the laws applicable where Vailea is operated, without regard to conflict-of-law rules. Disputes will be resolved in competent courts of that jurisdiction, unless mandatory consumer protection laws in your country provide otherwise.
